Hye Print reserves the right to make additions, deletions, or modification to the contents on the Service at any time without prior notice. The maximum liability to you on products purchased from Hye Print shall be limited to the purchase price of the products you paid. UNLAWFUL OR PROHIBITED CONDUCT

The Site may only be used for lawful purposes in accordance with the terms of this Agreement. As a condition of your use of this Site, you warrant to Hye Print that you will not use the Site for any purpose that is unlawful or prohibited by this Agreement. Specifically, but without limitation, you may not:

  • use or attempt to use any engine, software, tool, agent, data, or other device or mechanism (including browsers, spiders, robots, avatars, or intelligent agents) to navigate or search the Site other than the search engine and search agents provided by Hye Print or generally publicly available browsers;
  • upload, e-mail or transmit any material that contains software viruses or any other suspicious computer code.
  • violate or attempt to violate the security of the Site, including, without limitation: (i) accessing data not intended for you or logging onto a server or an account that you are not authorized to access.
  • commit any other act that is otherwise inappropriate for the Site, in Hye Print sole judgment.
  • make any use of data extraction, scraping, mining, or other data gathering tools, or create a database by systematically downloading or storing Site content, or otherwise scrape, collect, store, or use any Content, product listings, descriptions, prices, or images, except pursuant to the limited license granted by this Agreement;
  • solicit password or personally identifying information from other users;
  • use the Site to transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable or harasses or advocates harassment of another person or promotes information that you know is false, misleading or promotes illegal activities;
  • misrepresent the identity of a user, impersonate any person or entity, falsely state or otherwise misrepresent your affiliation with any person or entity in connection with the Site, or express or imply that we endorse any statement you make;
  • upload, post, e-mail or otherwise transmit any content that infringes upon any patent, trademark, trade secret, copyright or other proprietary right of any party, company or brand;
  • falsify or delete any copyright management information, such as author attributions, legal or other proper notices, proprietary designations, or labels of the origin or source of any material included on or uploaded to the Site;

REGISTRATION AND PASSWORDS

You may be required to register with Hye Print in order to access certain services in the website. Your username and passwords are for you only. We may refuse to grant to you the user name you request. If you register an account, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account.

TERMINATION

We reserve the right, with or without notice and in our sole discretion, to terminate your account or your use of the Site and to block or prevent future access to and use of the Site if you violate this Agreement, for any reason, or for no reason. Upon any such termination, your right to use the Site will immediately cease. You agree that we shall not be liable to you or any third party for any termination of your access to the Site. Upon termination, all provisions of this Agreement that are intended to survive termination, all representation and warranties, all limitations of liability, and all indemnities shall survive in such termination.

TRANSACTIONS

If you wish to purchase any product or service made available through the Site (each purchase, a “Transaction”), you may be asked to supply certain information relevant to your Transaction including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information. YOU CONSENT, REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY CREDIT CARD(S) OR OTHER PAYMENT METHOD(S) IN CONNECTION WITH ANY TRANSACTION. By submitting such information, you grant to Hye Print the right to provide such information to third parties for purposes of facilitating the completion of the Transactions/Orders initiated by you or on your behalf. Verification of information may be required prior to the acknowledgment or completion of any Transaction.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event we make a change to or cancel an order, we will attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to pay all charges that may be incurred by you or on your behalf through the Site, at the price(s) in effect when such charges are incurred including, without limitation, all shipping and handling charges. You remain responsible for any taxes that may be applicable to your Transactions.

Hye Print may use third-party electronic payment processors and/or financial institutions (ESPs) to process financial transactions. You irrevocably authorize us, as necessary, to instruct such ESPs to handle such transactions and you irrevocably agree that Hye Print may give such instructions on your behalf in accordance with your requests as submitted with your order. You agree to be bound by the terms and conditions of use of each applicable ESP, and in the event or conflict between these Terms of Use and the ESP’s terms and conditions then these Terms of Use shall govern.

Our Right to Not Accept Your Order or Cancel Your Purchase. Hye Print reserves the right to refuse any order for whatever reason. We also reserve the right to cancel any purchase (an order already accepted by us) in (amongst others) the following situations, without being liable for any damage or costs: the product is not available/in stock; your billing information is not correct or not verifiable; your order is flagged up by our security systems as an unusual order or an order susceptible to fraud; your bank transfer payment is not received within twelve (12) calendar days after acceptance of your order; there was an error in the price quote; or we could not deliver to the address provided by you.

AVAILABILITY, ERRORS, AND INACCURACIES

Please note that we cannot be responsible for: Spelling, punctuation or grammatical errors made by the customer, inferior quality or low-resolution of uploaded images, design errors introduced by the customer in the document creation process, errors in user-selected options such as choice of finish, quantity or product type, and damage to the products arising after delivery to the customer.Please preview your designs carefully and correct any mistakes prior to placing your order. Hye Print does not proof documents created by its customers prior to processing.

If an item is out of stock, Hye Print may, in its sole discretion and at no extra cost to you, substitute another item for the out-of-stock item if Hye Print, in its sole discretion, determines that the identical brand and product is available in a form that is of equal or greater value.

MISPRINTS OR ERRORS

Hye Print strives to ensure the information on the website is current and accurate. However, we cannot guarantee against any errors, inaccuracies, or omissions on its website nor does it offer compensation or accept liability for any consequences arising thereof. Hye Print reserves the right to correct any errors, omissions, or inaccuracies relating to the original products, customized products, Description, stock, pricing or any other information or pictures on the Website without prior notice or liability to you or any other person. In addition, Hye Print reserves the right to reject, cancel or terminate any order, including accepted orders for any reason and without liability or prior notice to you or any other person.

PRICES

All prices shown on hyeprint.ca are in Canadian Dollars and does not include the applicable taxes unless otherwise noted. The prices do not include shipping and handling nor any other services such as insurance. Price charged for orders will be the price at the time of the order.

Pricing Errors. Please note that even though our Site is composed with care, it is possible that the pricing information on our Site contains errors or due to a typographical error. Hye Print is not bound by our offer and we reserve the right to cancel your purchase in the event of such error. When such errors occur, and in the event a charge has been made to your credit card, Hye Print will issue a credit to your card to offset the purchase (In 3-5 business Days).

COLORS

Hye Print strives to display the colors of the products shown on the Site as accurately as possible; however, we cannot guarantee that your monitor’s display of any color will be accurate.

The Notice and Notice Regime – NOTICE AND PROCEDURE FOR MAKING CLAIMS OF COPYRIGHT INFRINGEMENT

Hye Print’s policy is to respond to notices of alleged infringement that comply with the The Notice and Notice regime. Copyright-infringing materials found on the Site can be identified and removed via our process listed below, and you agree to comply with such process in the event you are involved in any claim of copyright infringement to which the The Notice and Notice regime may be applicable.

If you believe in good faith that your work has been copied in a way that constitutes copyright infringement, please provide Hye Print’s copyright agent the written information specified below. Please note that this procedure is exclusively for notifying Hye Print that your copyrighted material has been infringed. Hye Print does not and will not make any legal decisions about the validity of your claim of infringement or the possible defenses to a claim. When a clear and valid notice is received pursuant to the guidelines set below, Hye Print shall respond by either taking down the allegedly infringing content or blocking access to it. Hye Print may contact the notice provider to request additional information. Under the The Notice and Notice regime, Hye Print is required to take reasonable steps to notify the user who posted the allegedly infringing content “Alleged Infringer”. The Alleged Infringer is allowed under the law to send Hye Print a counter-notification. Notices and counter-notices are legal notices distinct from regular Site activities or communications. We may publish or share them with third parties in our sole discretion (in addition to producing them pursuant to a subpoena or other legal discovery request). Anyone making a false or fraudulent notice or counter-notice may be liable for damages under the The Notice and Notice regime, including costs and attorneys’ fees. Any person who is unsure of whether certain material infringes a copyright held by such person or a third party should contact an attorney.

To file a The Notice and Notice regime notice, the copyright owner must send an email to hyeprint.ca@gmail.com. We reserve the right to ignore a notice that is not in compliance with the The Notice and Notice regime, and we may, but are not obligated to, respond to a non-compliant notice.

A The Notice and Notice regime notice must:

  1. Specify the copyrighted work(s) believed to have been infringed (for example, “My copyrighted work is the picture that appears at [list location where material is located].”);
  2. Identify the Content that a copyright owner claims is infringing upon copyrighted work. The copyright owner must provide information reasonably sufficient to enable us to locate the item on the Site. The copyright owner should provide clear screenshots of the allegedly infringing materials for identification purposes only. The information provided should be as detailed as possible;
  3. Provide information sufficient to permit us to contact the copyright owner directly: name, street address, telephone number, and email (if available);
  4. If available, provide information sufficient to permit us to notify the Alleged Infringer (email address preferred);
  5. Include the following statement: “I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law”;
  6. Include the following statement: “I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed”;
  7. Be signed; and
  8. The above information must be sent to hyeprint.ca@gmail.com.

Report Copyright Violations
You can report to us through our contact form if you notice any violations of your copyright. In case you find any person using your content without taking your permission, you can send a message to that person to drop the content. However, while reporting your copyright violation in a content discussion, you are not allowed to post any comment that is misleading, false, inaccurate and libelous. We will deal strictly with such comments.

Hye Print cannot decide whether content is a case of plagiarism. We are unable to do much about a work having influences of another works. We cannot deal with your accusations that someone has copied your work. But we can surely take action against the designers who have directly replicated a work.

JURISDICTIONAL ISSUES

The Site is controlled and operated by Hye Print located in Toronto, Ontatio, Canada, and is not intended to subject Hye Print to the laws or jurisdiction of any state, country or territory other than that of (Ontario) Canada. Hye Print does not represent or warrant that the Site or any part thereof is appropriate or available for use in any particular jurisdiction other than Canada. In choosing to access the Site, you do so on your own initiative and at your own risk, and you are responsible for complying with all local laws, rules and regulations. We may limit the Site’s availability, in whole or in part, to any person, geographic area or jurisdiction we choose, at any time and in our sole discretion.

YOUR SUBMISSIONS

You grant to Hye Print the limited license to original works you submit to our Site in order that Hye Print may administer our Site, for example to copy such original works to multiple servers (e.g., backup servers). Hye Print does not claim ownership of the original works which you submit to our Site. Note: Original works being defined as works that do not incorporate one or more images or fonts from the Hye Print library, i.e., two shapes purchased and welded together to form a separate image. By posting or submitting to our Site or in connection with any Sponsored Activity, you automatically grant Hye Print all rights necessary to prohibit any subsequent unauthorized aggregation, display, copying, duplication, reproduction, or exploitation of such Content by any party for any purpose. You grant Hye Print with a permission to modify, change, update, your picture/design sent to Hye Print to print it on a personalised product. Once Printed, Hye Print reserves the right to share, advertise, or use the final/printed product in Marketing and Advertising that includes but not limited to Hyeprint.ca website or any other external links, Hye Print social media pages, such as Facebook, Instagram, Etsy, YouTube, Pinterest, LinkedIn without your notice. You also agree that you shall not have any right, title, or interest in Hye Print’s intellectual property.

Things to mention:

  • We reserve the right to refuse the service if you supply with inappropriate photo, copyright, counterfeit, fake, faking logo and all sort of producing a counterfeit products
  • We reserve the right to refuse the service if you the printable items contains any sort of harrasement, racism, Discrimination.
  • We might not know the logo you’re printing after Hye Print due diligence, as a result it could lead to producing a counterfeit item, Hye Print is not responsible at all for any sort of counterfeit item produced by Hye Print unknowingly or unintentionally.
  • We might not accept to service you, if the design or the printables item is related to any sort of Crime, Hate, Bad faith.
  • Basic Design Explained: Basic Design is simply adding your picture and/or your logo including a text on the personalised item. Basic Design shall not take more than 10 minutes on a computer and cannot be combined with any offers. The basic design is a one-time service for bulk orders. If the customer orders in bulk quanities with separate design, the service will not be free and additional charges may apply. The Basic design that we provide to our customers are 100% complimentary. Hye Print reserves the right to stop or modify this complimentary service without prior notice.
  • If the item is damaged or the items damaged after use, Hye Print shall not responsible and/or liable on any injury caused by the damaged product.
  • Personalized sample items might not be exactly the same as the offered product, some items might have a slightly different color, size, shape or a missing feature.
  • By sending a file to print at Hye Print you are confirming that you own the copyright to, or have permission to copy the material in the file(s) you want to send.
  • Use of the image must not infringe copyrights.

TURNAROUND TIMES ARE NOT GUARANTEED
All of our turnaround times are estimates only and NOT guarantees. Please keep in mind that there are several different things that can go wrong with the printing process that are out of our control. The turnaround times that we give are based on actual statistics of jobs we have done in the past and are NOT guaranteed. Under no circumstances will a refund be honored for a delay in our estimated turnaround time. All orders placed after 7pm EST will be processed the following business day.

RETURN / REFUND POLICY

Return Policy

We unusually receive complements about the custom prints we do and hardware we sell, but In the unlikely event you’re unhappy with your product please follow these instructions to lodge return / refund claim:

Email us at hyeprint.ca@gmail.com with;

  • The date of your purchase
  • Your order number
  • What you would like to return
  • Why you want to return it.

Once received we will look into that and will try our best to resolve the problem soon.

What can be returned / not returned

  • Only Items that are faulty/damaged or have a faulty print may only be returned.
  • No returns are accepted after 14 days of receipt of purchase.
  • We do not accept items that have noticeable wear or makeup stains.
  • Returns must also comply with our user agreement.
  • We do not refund or exchange for change of mind, errors in approved proofs, shipping or stock delays or if the customer chooses the wrong size. numbers, colors, anything outside of this is faulty. 

Delivery time frames

We guarantee our processing and printing timeframes on our orders, but in the unlikely event that there is an error due to the courier, Canada Post, we cannot take responsibility, but in this rare instance, we can refund your shipping costs in full.

If you order a rush express order and your location is rural, US or not covered by the Canada Post Network then we cannot take responsibility for shipping timeframes.

Please contact us so we can look after you, well before your due date. We want you to receive your products on time and an email away.

Our Custom Apparel Washing Instructions

  • Cold water
  • Gentle cycle
  • Wash inside out
  • Do not tumble dry
  • Dry in shade

Garments will not shrink if the correct washing guidelines on the t shirt labels are followed; if you believe the garment was washed correctly please send us an email following our return instructions.

Online orders or orders where you upload your own artwork

Custom Printing takes great pride in its commitment to customer satisfaction. However, certain circumstances are beyond our control. Please note that we cannot be responsible for:

  • Spelling, punctuation or grammatical errors made by the customer.
  • Mistakes that the client has approved after being sent a proof*
  • If the artwork you as a client upload is low quality, and results in a poor print
  • 5% difference in design printing colours & size
  • 5% difference in the actual colours
  • Errors in user-selected options such as product type or size. *Please use our size guide for measurements or email us for advice.
  • Courier delivery timeframes

Custom Printing is not responsible for checking or modifying your artwork if you upload it directly to the site; to make changes such as; color changes, background removal or design work. Please email miztadecor@gmail.com to discuss artwork before uploading your image to our designer.

Proof Approval Disclaimer:

Verbal agreement, payment of an invoice or emailing a reply with approval constitutes authority to proceed.  Clients are requested to check thoroughly before approving. We have taken the utmost care creating your artwork, however are not liable for client error.  Due to the production process, colors, position, size & scale are indicative only. Artwork & concepts remain property of the Custom Printing  They must not be adapted or communicated to third parties or in anyway used without our expressed permission. 

Products, sizes, colors, printing techniques for online & offline orders

We order blank clothing, printable media from our distributers, and then customize these items with printing. All sizes and colors shown on our website are not under our control, and we can’t be held liable for color variations out of screen colors to real product colors, nor can we be held responsible for sizing problems (mainly for apparel printing). We do our best with our Quality Controls to handle those rare problems. We highly recommend ordering samples to ensure these size and color problems aren’t encountered.  

Intellectual Property & Trademark Disclaimer

All logos, brand names, trademarks, and copyrighted works are the property of their respective owners. You confirm that any text, design, or artwork you send to Hye Print for printing is either owned by you or you have the necessary rights and permissions to use it. By submitting your materials, you assume full responsibility for any infringement claims arising from copyrights, trademarks, or other intellectual property. Hye Print will not be held liable—nor shall we bear any costs or damages—if we unintentionally print materials that infringe third-party rights.
